The majority of the time, a Canadian has to be in Canada to sponsor his or her spouse or common-law partner for PR. But it is not the case all the time.
IRCC now allows Canadians to sponsor their spouses, conjugal partners, common-law partners, and dependent children from abroad. However, it is important for them to prove that they intend on shifting to Canada. This is at the time their sponsored family member becomes a PR holder.
The way that they prove their intention of moving back to Canada will depend on their individual motives to return and their situations. Take the example of a couple who wishes to move to Canada for work. They need to support their sponsorship application with the help of a confirmation of their employment.
If the couple is in search of a school or a daycare, they can submit their documents. These documents need to support their search. If the couple bought a home, they need to send in their land title. Any other communications with the realtor will also work.

Spousal sponsorship applications are still under-process in Canada. This has been going on despite the recent pandemic.
Immigration minister, Marco Mendicino, has said that Canada is trying to process 49,000 of these applications this year. The new immigration levels plan is planning to sponsor 80,000 people.
These will include spouses, children, and partners. Canada plans to sponsor 80,000 people every year for the next 3 years.
IRCC also aims to process new spousal sponsorship applications in 12 months.
Inland Vs Outland Sponsorship
It is possible for common-law partners and spouses to apply for Canadian immigration through 2 streams:
- In-land Sponsorship
- Out-land Sponsorship
A Canadian living abroad may sponsor their partner under the out-land sponsorship stream. This is as long as they both wish to shift to Canada.
After applicants enter Canada, they have the option of either applying for out-land or in-land sponsorship. When it comes to getting an open work permit, just the inland applicants are eligible for it. This permit will let a person work anywhere in the country while waiting for their application to get finalized.
These people should also hold a valid temporary status. This may include a visitor’s visa to be suitable for the work permit.
During the recent pandemic, immediate family members are out of travel restrictions. There is no urgent reason for them to enter Canada. This is as long as they plan to spend a minimum of 15 days in Canada and complete their quarantine requirement.
Based on their origin country, foreign national partners will require a valid TRV or eTA to enter Canada.
