Immigration Freeze Extended By Trump until March End

With just a few weeks remaining in Donald Trump’s presidency, he has extended the previous immigration freeze. This shall be until March 31, 2021.

He raised a moratorium on temporary work visas for tech and other companies. This will drastically impact the foreign workers who enter the U.S.

Several sectors, such as tech, tourism, and specific au pairs, will get affected by this proclamation. Trump signed this decree because the entry of foreign workers into the U.S. posed a threat to U.S. workers. This will displace and disadvantage the US workers during the economic revival following the COVID-19 outbreak.

The U.S. Chamber of Commerce forcibly opposed this Moratorium before its extension. The National Associations of Manufacturers stated that an immigration freeze would hurt the U.S. economic interests. Thus, they filed lawsuits as per the NPR report.

On January 20, President-elect Joe Biden will be sworn into office. It appears at the time of writing that the democrats are quite sure of controlling the Senate.

With control over three government and senate majority branches, it will be easier for Biden to pass immigration reforms. However, it is unclear if immigration reforms will be prioritized given the Covid-19 crisis.

Immigration Pathways to Canada for H-1B Holders

Trump’s decree has affected the H-1B visa. This is especially for foreign nationals working in the tech sector in the U.S.

H-1B holders have moved north to immigrate to Canada. This was before the Trump government took over. The simple reason being Canada has numerous permanent residence routes for tech workers.

One such example of an expedited work permit is The Global Talent Stream. This permit allows Canadian companies to bring in foreign tech talent to work within a few weeks. The designated high-growth companies either hire these workers or get a job offer for an in-demand occupation.

The Express Entry (EE) System is Canada’s popular and well-designed immigration pathway for tech workers.

EE is an application management system. It has been designed for federal high skilled immigration programs and a few PNPs. Comprehensive Ranking System (CRS) ranks the profiles submitted by the candidates into the EE System. The highest-scoring candidates get invited for Canadian permanent residence through regular EE draws.

Tech workers are in a strong position to get Canadian permanent residence through the EE System. Generally, the U.S. tech workers are well-educated, skilled, and experienced. They also have a high level of English language proficiency. The value of all of these aspects is quite high on the CRS.

Moreover, there are numerous PNPs, such as B.C.’s weekly Tech Pilot draws and the Ontario Immigration Nominee Program Tech draw. These selective target candidates with tech experience.
