LMIA Necessary for British Citizens to Work in Canada

Starting January 1, 2021, British nationals willing to work in Canada will need a Labour Market Impact Assessment (LMIA).

Citizens of the UK will continue to be processed. This will be under the Canada-European Union Comprehensive Economic and Trade Agreement (CETA). This will continue till the end of this year. In other words, British nationals will remain exempted from LMIA till December 31, 2020.

Last month, the United Kingdom and Canada signed an agreement. It was called the Canada-UK Trade Continuity Agreement (TCA).

It was important for the United Kingdom to sign a new deal with Canada as it officially left the European Union. This agreement will help not to disrupt trade between the two nations.

A study was conducted by Global Affairs Canada. It stated that in the absence of a deal, both the countries will lose their respective gross domestic product. It also said that more than 2,000 Canadian jobs would be lost.

The activation of this deal is said to start early next year. In other words, British nationals will need an LMIA from January 1. This shall continue until they decide to implement the Canada-UK TCA.

If they meet the requirements of the LMIA-exempt work permit category, British nationals may also work in Canada.

The new Canada-UK TCA will be quite similar to several terms seen in CETA. This will give more time to both Canada and the UK to choose the terms that they wish to implement forever.

This also means that British nationals will be exempted under the new deal.

What Do You Mean By LMIA?

It is important for any Canadian employer to prove to their government the need to hire a foreign worker to fill a vacancy. However, this needs to be done before hiring a foreign worker.

An LMIA is a document that helps a Canadian employer achieve this. A positive LMIA will signify the need to hire a foreign worker. There are certain situations wherein, certain work permits do not need an LMIA.

This is due to the free trade agreements, like the Canada-United States-Mexico Agreement and the CETA.

There are some open work permits that are exempt from LMIA. These permits are available for those workers who lack a job offer. These may include spousal open work permits and post-graduate work permits meant for foreign graduates.

Openwork permits let holders work for any employer in Canada. On the other hand, closed work permits let holders work for a specific employer only.
